Subject: Discrepancies in September Cycle of Rule‑38 Transfers and request for extension of last date – reg.

Respected Sir,

My Federation would like to draw your kind attention to certain discrepancies being faced by officials in the September 2026 cycle of Rule‑38 transfers, particularly in cases involving periods of Dies Non/Non‑Qualifying Service (NQS). It has been brought to our notice that there appears to be an issue in APT in respect of officials who have applied for Rule‑38 transfer and have a period of Dies Non/NQS in their service.

In cases where the Dies Non/NQS period occurred well before the official became eligible to apply for Rule‑38 transfer, entry of the said period by the Divisional Office during verification is resulting in the official being automatically treated as ineligible for the current Rule‑38 cycle.

In such cases, the date of completion of one year of qualifying service should appropriately be recalculated and updated in APT after excluding the Dies Non/NQS period. Once the official has completed the prescribed qualifying service after such exclusion and is otherwise eligible for the current cycle, subsequent entry/verification of the already accounted‑for Dies Non/NQS period should not result in denial of eligibility.

Otherwise, the official is effectively subjected to a double disadvantage—first, by exclusion of the Dies Non/NQS period while calculating qualifying service, and secondly, by denial of an opportunity to participate in the current Rule‑38 cycle, thereby compelling the official to wait for the next cycle after another six months.

The above case was rejected by the Divisional Office on the ground that the official had not completed one year of qualifying service. However, after excluding the two days of NQS, the revised date of completion of the prescribed qualifying service ought to be appropriately determined and reflected in APT, and eligibility should be decided accordingly.

Request

In view of the above, my Federation requests the competent authority to kindly examine the issue urgently and make necessary corrections/modifications in APT, so that, in respect of affected officials, the date of completion of one year of qualifying service is automatically recalculated after excluding the Dies Non/NQS period. Officials who have completed the required qualifying service should not be deprived of their legitimate opportunity to participate in the current Rule‑38 cycle merely because of a system‑related issue.

My Federation further requests that, considering the above technical difficulties and in order to provide a fair opportunity to all eligible officials, the last date for submission of applications for the current Rule‑38 cycle may kindly be extended from 31.08.2026 to 30.09.2026.

An early intervention and favourable action in the matter is earnestly requested.
