India Post Promotion Order 2026: 27 Junior Engineers (Civil) Promoted to Assistant Engineers

OFFICE ORDER

A review DPC was convened on 06.12.2019 for promotion from Junior Engineer (Civil) to Assistant Engineer (Civil) for the DPC held on 26.06.2009 (order dated 02.07.2009) in the light of revised seniority of the feeder grade issued vide order dated 16.05.2014 with position as on 28.12.2005. Thirty-one (31) officers who were earlier promoted in the DPC of 26.06.2009 were not covered by the review DPC held on 06.12.2019 because of their lowered seniority position in the feeder grade.

The seniority of the feeder grade JE (Civil) was modified vide order dated 16.05.2014 with position as on 28.12.2005 in accordance to order dated 06.07.2011 of the Hon'ble High Court of New Delhi in WP(C) No.372-76/2006 which was subsequently upheld by the Hon'ble Supreme Court vide order dated 10.07.2017 in SLPs No.29634-29638/2011 & 107447-51/2012.

The outcome of the review DPC dated 06.12.2019 was notified vide order No. 5-7/2016/ Vol.II/CWP/555 dated 23.12.2019. However, the said 31 officers who were not covered in the review DPC were granted status quo as Assistant Engineer (Civil) vide order No. 5-7/2016/ Vol.II/CWP/556 dated 23.12.2019 who were working as regular Assistant Engineer (Civil) then subjected to final outcome of various pending Court/CAT decision in the following matters-

i. OA No.2192/2016 filed by Shri L.K. Sharma & Others Vs U.O.I and Others.

ii. OA No.4148/2016 filed by Shri Mukhtiar Singh & Ors before Central Administrative Tribunal, Principal Bench, New Delhi.

iii. OA No.479 of 2014 filed by Shri C. Sreenivas before the Hon'ble CAT, Ernakulam Bench. The Hon'ble Tribunal has granted an interim stay for operation and implementation of final seniority list in the grade of Junior Engineers issued on 16-05-2014 to the extent it relates to the extent it relates to the reversion of the applicant.

iv. OA No. 180/00440/2014 filed by Shri T. Vijaya Kumar and others V/s U.O.I. before the Hon'ble CAT, Ernakulam Bench.

v. OA No. 350/01128/2017 filed by Shri Deb Kumar Ganguly & Ors. V/s U.O.I. & Ors before the Hon'ble CAT, Calcutta Bench, Kolkata.

vi. OA No. 411/2017 filed by Shri Binod Kumar V/s UOI & Ors before the Hon'ble CAT, Patna Bench.

The Court/CAT cases in Para 3 above based upon which the status quo was granted to the said 31 officers have now been disposed in March 2024 and there is no relief granted by the Hon'ble Court/CAT for restoring their seniority as per their plea in the Petition/ O.A.

Three officers out of 31 had either superannuated or deceased as on 02.06.2020. One officer doesn't have clear Vigilance Clearance Certificate. Accordingly, remaining 27 officers are being promoted from JE © to AE © as per the recommendation of the DPC based upon evaluation of Service Record.

Accordingly, the competent authority is pleased to promote 27 officers from JE(C) to AE(C) with effect from 02.06.2020 in suppression of order No. 5-7/2016/ Vol.II/CWP/556 dated 23.12.2019 and partial suppression of order No. 3-2/2008-CWP dated 02.07.2009 (DPC dated 26.06.2009).

The period from 26.06.2009 to 01.06.2020 for the aforesaid 27 officers shall be treated as AE(C) on ad-hoc basis.

As all the officers are already working in the substantive pay scale of Assistant Engineer in Pay level-7, it doesn’t require re-pay fixation.
