CCS (LEAVE) RULES, 1972 for IP Exam 2025

All Leave Rules in a Nutshell

Effective Date: 1st June, 1972

Applicability: Government servants appointed to Civil Services and posts in connection with Union affairs

Not Applicable To: Persons paid from contingencies, industrial establishments, governed by Fundamental Rules, or serving temporarily from State Govt.

General Leave Provisions

  • Leave is not a right; can be refused or revoked
  • Leave kind cannot be altered unless requested in writing
  • Medical Authority's advice is binding for medical leave
  • Leave should not be denied in last 10 years of service

Leave Credit and Commutation

Dismissal: All leave at credit ceases

Technical Resignation: Leave is carried forward

Commutation Time Limit: 30 days

Commutation Not Allowed: After ceasing service

Leave Combinations and Restrictions

  • Casual leave cannot be combined with other leave
  • Half-day casual leave can be combined with regular leave under compelling grounds
  • Leave exceeding 5 years requires President's sanction

Leave Application and Maintenance

Form: Leave application must be in Form 1

Gazetted Officers: Leave account maintained by Audit Officer

Admissibility Report: Must be obtained before granting leave

Medical Leave Rules

  • Medical certificate required for Gazetted officers
  • Second opinion may be sought by competent authority
  • Medical certificate may be waived for leave under 3 days
  • Leave not refused even if return to duty is uncertain

Earned Leave

  • Credit: 15 days each on Jan 1 and July 1
  • Max Accumulation: 300 + 15 days
  • Ceiling: 180 days in India, 300 days with 120 outside India

Half Pay Leave

Credit: 10 days each on Jan 1 and July 1

Reduction: 1/18 of Dies-Non

Max Accumulation: No ceiling

Commuted Leave

  • Debited twice the amount from HPL
  • Generally granted on medical certificate
  • Up to 60 days without certificate after maternity/adoption

Leave Not Due

  • Granted when no HPL is available
  • Max 360 days in service
  • Recoverable on resignation/voluntary retirement

Extraordinary Leave

  • Granted when no other leave is admissible
  • No leave salary during EOL
  • Max 24 months for study after 3 years of service

Leave Preparatory to Retirement

Max 300 days of EL and HPL; EOL not included

Maternity Leave

  • 180 days for female Govt. servant with <2 children="" li="">
  • 45 days for miscarriage/abortion
  • Max 2 years continuation leave without certificate

Special Maternity Leave

  • 60 days for death of child soon after birth/stillbirth
  • Defined as death within 28 days of birth
  • Only for authorized hospital deliveries

Paternity Leave

  • 15 days for male Govt. servant with <2 children="" li="">
  • Can be availed within 6 months of delivery

Child Adoption Leave

  • 180 days for female Govt. servant with <2 children="" li="">
  • Not debited against leave account

Child Care Leave

  • 730 days for female Govt. servant with children <18 li="" years="">
  • Single male Govt. servant also eligible
  • 100% salary for first 365 days, 80% for next 365

Work Related Illness and Injury Leave (WRIIL)

  • Full pay during hospitalization
  • 6 months full pay + 12 months half pay post-hospitalization
  • Half pay may be commuted to full pay

Special Leave for Sexual Harassment Inquiry

Up to 90 days for aggrieved female Govt. servant; not debited from leave account

Study Leave

  • Min 5 years service required
  • Max 12 months at a time, 24 months in service
  • Can be taken in multiple spells
  • Refund required if not returning to duty
