Sir/Madam,

I am directed to refer to this office letter no. 4-1/2025 dated 07.08.2025 issued to Kerala Circle and letter no. 4-2/2025-PCC dated 01.10.2025 issued to Tamilnadu Circle, wherein clarifications were conveyed regarding grant of MACP in cases involving declination of promotion earned through LDCE.

The court matter involved the similar issue was referred to nodal department DoP&T to seek their comments "whether the promotion earned through LDCE is treated as promotion for the purpose of grant of financial upgradation under MACP Scheme. In response, DoPT vide ID Note dated In response, DoP&T vide ID note dated 27.11.2025 has clarified that "appointments made through LDCE are treated against 'Promotion' quota and not 'Direct Recruitment' quota. Recruitment to a post which provides for mode of recruitment as promotion through LDCE is treated as promotion only for the purpose of grant of financial upgradation under ACP/MACP Scheme". DoPT also observed that refusal of such promotion tantamount to refusal of normal promotion earned through seniority.

In view of the above clarification of the DoPT, the Circles are requested to take necessary action in accordance with the aforesaid clarification of DoP&T in the above-mentioned cases as well as in all similar cases, in supersession of this office letters dated 07.08.2025 and 01.10.2025.

This issues with the approval of the Competent Authority.
