Subject: Guidelines to deal with the appointment of GDS to the Departmental Posts in the event of pendency of Disciplinary/Criminal Proceedings, Put off duty and currency of punishment on GDS – reg.
Sir/Madam,
Please refer to this Directorate OM No. 17-47/2024-GDS dated 14.10.2024 and letter of even no. dated 13.01.2026 (copies enclosed) on the above-mentioned subject.
This office is in receipt of references from some of the Circles regarding the applicability of guidelines issued vide ibid OM dated 14.10.2024 under the following circumstances:
a) Where the result of departmental examinations for Postman/Mail Guard and MTS (Vacancy Years 2023 and 2024) was issued in part – some were declared before 14.10.2024, and others (like supplementary or provisional results) after 14.10.2024.
b) Where GDS candidates have been provisionally permitted to appear in the LDCE/Competitive Examination (CE) for promotion to PA/SA or PM/MG/MTS, as the case may be, owing to a disciplinary/criminal case pending or contemplated, in respect of LDCE/CE held prior to the issue of said guidelines.
With regard to the clarification sought in respect of the result issued in parts, it is clarified that the instructions issued vide letter dated 14.10.2024 shall take effect from the date of issue, and will be applicable in all cases where the results of the Departmental Examination had not been declared as on that date. However, these instructions shall not be applicable in cases where the results of the Departmental Examination had already been declared partially prior to 14.10.2024, even if the remaining part of the result is declared subsequently after 14.10.2024.
Accordingly, except in the cases where the result was issued in part as mentioned in para (3) above, in the remaining cases, Circles are required to take action on the basis of the guidelines issued by OM dated 14.10.2024 in respect of candidates allowed to appear provisionally in the respective examinations, even though the disciplinary action was initiated prior to 14.10.2024.
This also disposes of the clarifications sought by Maharashtra Circle vide Letter no. Estt/Clarification/2024 dated 22.01.2026 and Uttar Pradesh Circle letters no. APMG (Con)/M-77/LDCE-CE/PM-MG-MTS/DE/2023/Ch-II dated 17.04.2026 & Rectt/Complaint/Sh. Anuruddha Kumar Pathak/Kanpur(M)/2025/4 dated 22.04.2026.
This issues with the approval of the Competent Authority.
