Standard Operating Procedure (SOP) for Handling of Court Cases in Department of Posts

Background

The Department of Posts observed delays in filing replies, counter-affidavits, appeals, and implementing court orders, leading to adverse legal consequences and increased expenditure. To address these issues, a comprehensive SOP has been introduced to ensure timely and effective handling of court cases.

Key Objectives

  • Achieve zero contempt proceedings.
  • Adherence to the 30-day timeline for filing counter-affidavits.
  • Timely filing of appeals against adverse orders.
  • Mandatory use of e-Office or official email for legal communications.

Preventive Measures

  • Employee representations on service matters must be disposed of within one month.
  • Policy-related representations should be referred to the Directorate within seven days.
  • Interim replies should be issued if inputs from higher authorities are delayed.
  • All representations must be disposed of through reasoned and speaking orders to reduce litigation.

The SOP lays down procedures for handling:

  • Consumer Forum cases.
  • Central Administrative Tribunal (CAT) cases.
  • High Court cases.
  • Supreme Court (SLP) matters.
  • Other judicial and quasi-judicial forums such as Labour Courts, Civil Courts, Lok Adalats, etc.

  • Legal proposals and appeals to be processed electronically.
  • Timely examination of judgments and decisions on implementation or appeal.
  • Directorate approval mandatory for filing Special Leave Petitions (SLPs) before the Supreme Court.

Monitoring and Review Mechanism

  • Monthly review of pending cases by Divisional/Unit Heads.
  • Quarterly review by Regional and Circle Offices.
  • Maintenance of Litigation Monitoring Register/e-Office Dashboard.
  • Tracking of hearing dates, limitation periods, responsibilities, and case status.

Legal Drafting Guidelines

  • Verify all facts from official records.
  • Examine maintainability, jurisdiction, and limitation aspects.
  • Refer to applicable rules, policies, and judicial precedents.
  • Ensure replies and affidavits are legally sustainable and filed within prescribed timelines.

Priority Litigation

The following cases require urgent attention:

  • Matters involving Government policy or statutory provisions.
  • Cases with significant financial implications.
  • Conflicting judicial decisions.
  • Cases having all-India impact or affecting multiple Circles.

Limitation and Digital Processing

  • Limitation alerts to be generated 30, 15, and 7 days before expiry.
  • Appeals should not be filed mechanically; only meritorious cases should be pursued.
  • e-Office, official email, scanned documents, and virtual meetings should be used to expedite litigation management.

Expected Outcome

The SOP aims to strengthen legal compliance, improve accountability, reduce avoidable litigation, prevent contempt cases, and safeguard the interests of the Department through a structured and time-bound litigation management system
