Subject: Withdrawal of 3% fitment allowed to officials already granted MACPS, on their promotion to Inspector Posts - regarding
Sir/Madam,
I am directed to refer to this office letter No. 20-27/2015-SPB-II dated 20.08.2018 on the above-mentioned subject wherein 3% fitment benefit was allowed to the officials at the time of fixation of pay on promotion to the post of Inspector Posts even after availing financial upgradation under MACP.
- Department of Personnel & Training (DoP&T) in one of the similar type of matter, has advised to review the pay fixation in terms of Para 4 of Annexure-I of MACP Scheme issued vide their OM No. 35034/3/2008-Estt.(D) dated 19.05.2009. Para 4 of Annexure-I of MACP Scheme provides as under:-
“Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available.”
- The matter has been examined in consultation with Establishment Division of the Department and it has been observed that Recruitment Rules of Inspector Posts clearly provide promotional hierarchy quota for Postal / Sorting Assistant subject to fulfilment of certain service condition for their promotion through Limited Departmental Competitive Examination (LDCE). As such, promotion of Postal / Sorting Assistant to Inspector Posts cadre through LDCE is promotion and not direct recruitment. Therefore, it cannot be said that Inspector Posts cadre is not in promotion hierarchy of PA/SA.
- Accordingly, the matter has further been examined and it has been decided by Competent Authority to withdraw the above said letter No. 20-27/2015-SPB-II dated 20.08.2018.
- In view of the above, all cases falling under these categories may be reviewed and pay may be fixed accordingly. DOPT OM No. 18/03/2015-Estt (Pay-I) dated 02.03.2016 provides guidelines for recovery of wrongful/excess payments made to Government servants. Rule 70 of CCS (Pension), Rules, 1972 provides the guidelines for revision of pension of retired employees.
