Subject: Grant of limited Trade Union facilities to All India Postal Employees Union Group ‘C’ in compliance with judgment dated 06.12.2025 of Hon’ble High Court of Jharkhand in W.P. No. 3395 of 2023 – regarding.
All India Postal Employees Union Group ‘C’, an Association recognized under the provisions of CCS (RSA) Rules, 1993, had filed W.P. No. 3395 of 2023 before the Hon’ble High Court of Jharkhand seeking grant of limited trade union facilities as extended to Bharatiya Postal Employees Federation (BPEF) and its affiliated Associations.
The Hon’ble High Court of Jharkhand vide judgment dated 06.12.2025 in W.P. No. 3395 of 2023 has directed the Department to extend similar treatment to AIPEU Group ‘C’ as has been extended to BPEF and its affiliated Associations.
Accordingly, in compliance with the directions of the Hon’ble High Court of Jharkhand in its judgment dated 06.12.2025 in W.P. No. 3395 of 2023, the following limited Trade Union facilities, as have been extended to BPEF and its affiliated Associations, non-recognized Associations, with the approval of the competent authority are hereby extended to AIPEU Group ‘C’:
(i) Channel of communication
(ii) Meeting with senior officers; viz., Circle, Regional and Divisional Heads
(iii) Office accommodation subject to availability
(iv) Special Casual Leave of 10 days to 7 of its office bearers at Circle, Regional and Divisional level to attend All India Conference/Executive Committee meetings, union seminars with senior officers as and when called for
(v) Immunity in transfer to 2 of its Office Bearers at Circle, Regional and Divisional level from Head-Quarter
The above Trade Union facilities shall remain in force till completion of the membership verification process and subject to the outcome of LPA No. 436 of 2026 filed before the Division Bench of the Hon’ble High Court of Jharkhand challenging the judgment dated 06.12.2025 in W.P. No. 3395 of 2023, whichever is earlier.
The grant of the above limited facilities shall not be construed as recognition or restoration of recognition of All India Postal Employees Union Group ‘C’. The de-recognized status of the Association shall continue to be governed by the applicable provisions of CCS (RSA) Rules, 1993 and orders/instructions issued by the Department from time to time.
