Subject: Protection of tenure of duly elected office-bearers of existing recognised Service Associations consequent upon creation/reclassification of a new distinct category under the CCS (RSA) Rules, 1993 – Request for suitable transitional provision – Regarding.
The Federation draws attention to the Department’s Order No. SR-10/6/2026-SR-DOP dated 10.08.2026 regarding verification of membership of Service Associations under CCS (RSA) Rules, 1993, which introduced 15 distinct categories, including a new Category No. 15 – Group ‘B’ Non-Gazetted (Postal & RMS) covering HSG-II, HSG-I, and HSG-I (NFG) officials.
While welcoming transparent categorisation, the Federation raises concerns about continuity of tenure for duly elected office-bearers of recognised Service Associations. Key points include:
No retrospective termination of tenure:
- Rules do not provide for automatic termination of elected office-bearers due to reclassification.
- Department’s instructions dated 10.07.2026 extended recognition for six months, reflecting continuity during transition.
Avoiding anomalous positions:
- Office-bearers elected under earlier categorisation should not lose tenure due to administrative changes.
Need for transitional arrangement:
- Current order lacks mechanism for handling office-bearers elected before revised categories.
- Risk of disputes if tenure is questioned solely on reclassification.
Request for protection till next election:
- Existing office-bearers should continue until the next duly convened conference/election.
Uniform application:
- Clarification should apply uniformly across all Circles/Regions to avoid inconsistent interpretations.
Specific demands:
- Issue clarification that reclassification does not terminate tenure.
- Permit continuation of existing office-bearers until next election.
- Apply revised categories only for future membership verification.
- Prevent action against office-bearers solely due to cadre reclassification.
- Issue clarification before finalisation of membership verification process.
- The Federation emphasizes that the exercise of creating distinct categories should strengthen democratic recognition without prematurely displacing elected representatives.
