Technical Resignation and Lien Guidelines for Government Employees | DOPT Consolidated Rules
1. Technical Resignation
- Resignation is treated as technical when a government servant applies through proper channel for another post and is required to resign for administrative reasons.
- Benefits of past service are admissible if conditions are met, even if "Technical" is not explicitly mentioned.
- Applies to those who applied before joining government service, subject to specific conditions.
2. Carry Forward of Leave Benefits
- Unutilized leave (including Child Care Leave) is carried forward.
- Permanent absorption in PSUs/Autonomous Bodies allows cash equivalent of leave salary (up to 300 days).
3. Carry Forward of LTC
- LTC entitlement is carried forward for technical resignations.
- Employees resigning within 8 years are treated as fresh recruits for the remaining period.
4. Pay Protection and Increment Eligibility
Pay is protected if the new post's pay is lower than the previous substantive post.
Past service counts for annual increment eligibility.
5. GPF Transfer
Governed by Rule 35 of the General Provident Fund (Central Services) Rules, 1960.
6. Seniority
- Seniority in the substantive post is protected.
- Time spent in another department post-resignation does not count for promotion qualifying service.
7. Pension Scheme
- Past service counts for pension if the new post is pensionable (for those who joined before 01.01.2004).
8. New Pension Scheme (NPS)
- PRAN and PRA balance are carried forward to the new office.
9. Service Book Transfer
- Maintained from the first appointment and transferred with the employee.
10. Medical Examination
- Not required if already examined for a previous post with the same standards.
11. Lien
- Defined as the right to hold a regular post, subject to conditions.
- Retained during duties, foreign service, leave, or suspension.
- Terminated upon acquiring a lien on another permanent post.
12. Joining Time and Allowances
- Entitlements include joining time pay, DA, and transfer traveling allowance for eligible employees.
