Subject: Forwarding of common order dated 27.02.2025 of Hon'ble CAT, Hyderabad Bench in OA No. 317 of 2018 and other connected cases regarding Reserved Trained Pool (RTP) personnel service claims.

Key Observations from Tribunal Order (27.02.2025):

  1. Legal Precedent: The Tribunal upheld the Supreme Court's ruling in Union of India vs. K.N. Sivadas, stating that RTP service prior to regular absorption cannot be counted for benefits like LDCE, TBOP, or MACP, as per the RTP scheme's terms.
  2. Delay and Laches: Claims raised decades after absorption were dismissed due to inordinate delay, noting that applicants had accepted terms initially without objection.
  3. Judicial Consistency: Relied on Madras High Court orders (24.01.2023 and 04.11.2024) rejecting similar claims, emphasizing administrative impracticability and potential injustice in reopening old cases.
  4. No Automatic Entitlement: Reliefs granted in isolated cases do not create a universal right for all RTP personnel.
