Sub: Request for issuance of clarification regarding acceptance of new membership and thereof deduction of monthly subscription in favour of All India Postal Employees Union Group ‘C’.

Respected Sir,

It is submitted that two cases concerning the above subject were filed before the Hon’ble High Court of Calcutta, viz. WP No. 12853/2023 and WP No. 1334/2024. In this regard, your kind office had issued necessary clarification/instructions to all the Circle Heads vide Letter No. SR-09/1/2024-SR-DOP dated 12.06.2024, in compliance with the interim orders passed by the Hon’ble High Court of Calcutta in the aforesaid matters.

It is further submitted that the Hon’ble High Court of Calcutta has now pronounced its final judgments in both the above-mentioned cases. However, despite the final adjudication by the Hon’ble Court, it has been brought to the notice of this Union that several Divisions are still neither accepting the new membership of employees in favour of All India Postal Employees Union Group ‘C’ nor effecting deduction of the monthly membership subscription from the salaries of the willing members.

The continued non-implementation of the directions of the Hon’ble High Court at the field level is causing unnecessary difficulties to employees who have voluntarily opted for membership of this Union. In view of the final judgments pronounced by the Hon’ble High Court, a clear and specific clarification from the Directorate is considered necessary so that the orders of the Hon’ble Court are implemented uniformly and in their true spirit by all concerned authorities.

In view of the above, it is, therefore, requested that your kind office may graciously issue necessary clarification/instructions to all the Circle Heads for ensuring acceptance of new membership in favour of All India Postal Employees Union Group ‘C’ and deduction/remittance of the monthly membership subscription from the salaries of the willing members, in accordance with the applicable rules and the orders of the Hon’ble Court.

An early clarification in the matter is earnestly requested.
