Subject: Clarification regarding grant of financial upgradation under the MACP Scheme in respect of MTS officials whose willingness/unwillingness for promotion to the Postman cadre was obtained prior to their consideration by the Departmental Promotion Committee.
Sir/Madam,
Representations have been received regarding cases where willingness for promotion to the Postman cadre against the Seniority-cum-Fitness quota earmarked for MTS officials was obtained from officials falling within the zone of consideration before completion of the promotion process. In some cases, the unwillingness furnished by such officials at the pre-selection stage was treated as refusal of regular promotion for the purpose of the MACP Scheme, resulting in denial or deferment of financial upgradation under Para 24 of the Scheme.
2. The matter has been examined and it has been noted that Para 24 of the MACP Scheme stipulates that where a regular promotion has been offered and refused by an employee before becoming entitled to financial upgradation, such employee shall not be eligible for financial upgradation under the Scheme. The provisions of Para 24 are, therefore, attracted only in cases where an actual offer of regular promotion has been made and refused by the employee.
3. Furthermore, seeking an official's willingness or unwillingness prior to consideration by the Departmental Promotion Committee is contrary to the prescribed procedure governing regular promotion.
4. In view of the above, it is clarified that unwillingness furnished by an MTS official before consideration by the Departmental Promotion Committee (DPC), including unwillingness obtained merely because the official falls within the zone of consideration for promotion to the Postman cadre, shall not be treated as refusal of a regular promotion for the purpose of Para 24 of the MACP Scheme. Accordingly, financial upgradation under the MACP Scheme shall not be denied or deferred solely on the basis of such pre-selection unwillingness.
5. It is, however, further clarified that where an MTS official was found fit and recommended by the DPC for regular promotion to the Postman cadre against an available vacancy, but promotion orders were not issued solely because of unwillingness furnished in advance, such unwillingness shall be deemed to constitute refusal of the regular promotion that would have been offered to the official. Accordingly, the provisions of Para 24 of the MACP Scheme shall be applicable in such cases.
6. In cases where MTS officials who had furnished advance unwillingness were not considered at all by the DPC on that ground, the cases shall be placed before the appropriate DPC for review in accordance with the prescribed procedure. Based on the recommendations of the DPC, further action regarding promotion and applicability of Para 24 of the MACP Scheme shall be taken in terms of the above clarification.
7. All Circles are, therefore, requested to examine all such cases and take appropriate action in accordance with the above guidelines.
